01. Introduction

These Terms & Conditions ("Terms") govern your use of the Kingsbury Tour (Pvt) Ltd website. "Kingsbury Tour (Pvt) Ltd", "we", "us" and "our" refer to Kingsbury Tour (Pvt) Ltd; "you" and "traveller" refer to anyone using our website or requesting our services; "website" means this website and its subpages; "services" means the travel-planning services we offer, including preparing itineraries and quotations and coordinating travel arrangements; "booking" means a journey confirmed in accordance with Section 10; "itinerary" means a proposed or confirmed schedule of destinations, accommodation, transport and experiences for a journey.

02. Acceptance of Terms

By using this website, you agree to these Terms. If you do not agree with them, please do not continue to use the website. Simply browsing our website to learn about Sri Lanka or our services does not create a booking or any financial obligation — see Section 06 for how a tailor-made journey actually becomes a confirmed booking.

03. Website Use

When using our website, please agree not to:

• attempt to gain unauthorized access to any part of the website or its underlying systems;
• introduce viruses, malware or other harmful code;
• interfere with or disrupt the website's normal operation;
• scrape, copy or reproduce protected content beyond what's reasonably needed to browse the site, without our permission;
• submit false, fraudulent or misleading information through our forms;
• impersonate another person or misrepresent your affiliation with any person or entity; or
• use the website for any unlawful purpose.

We may take reasonable steps to protect the website against activity of this kind, including restricting access where necessary — see Section 28.

04. Travel Information

The destinations, activities, sample itineraries, photographs, durations, descriptions and accommodation examples on this website are provided as general travel-planning information to help you plan a trip — not a guarantee of exact conditions on any given day.

Travel conditions can and do change, due to weather, road conditions, traffic, seasonal availability, attraction opening times, government restrictions, local conditions, supplier availability, or other operational circumstances. Where you have a confirmed booking, we'll aim to keep you informed of anything that materially affects it — see Section 13.

05. Tours & Itineraries

The tours and sample itineraries shown on our website — including on our Tours page — are illustrative starting points, not fixed products. They're subject to availability and may be adjusted for operational reasons, or customized at your request into a tailor-made journey.

Once a specific itinerary has been confirmed as part of a booking (Section 10), we won't make material changes to it except as described in Section 13, or with your agreement.

06. Tailor-Made Journeys

Most journeys with Kingsbury Tour (Pvt) Ltd follow a tailor-made process along these general lines:

• you share your travel plans and interests with us, typically through our Plan Your Journey form;
• we review what you've told us;
• we may get in touch to discuss your preferences in more detail;
• we may prepare a proposed itinerary;
• you review the proposal;
• we discuss and refine any changes you'd like;
• we may issue a quotation for the journey (Section 07); and
• the journey becomes a confirmed booking only once the conditions in Section 10 are met.

Submitting the Plan Your Journey form, or any other enquiry, is the start of this conversation. It is an enquiry, not a booking, and does not by itself create a contract between you and Kingsbury Tour (Pvt) Ltd.

07. Enquiries & Quotations

Submitting an enquiry doesn't necessarily create a contract between us. Any itinerary or quotation we prepare in response reflects availability at the time it's prepared, and prices and availability may change before a booking is confirmed.

08. Prices

Prices shown on our website, or quoted to you directly, are indicative and based on the specific inclusions described at the time. They may be subject to availability and can change before a booking is confirmed. Where taxes, service charges or other fees apply, we'll aim to make their treatment clear in your quotation.

09. Payment

Confirmed bookings may require payment in accordance with the applicable quotation or booking confirmation.

10. Booking Confirmation

Until a booking is confirmed on this basis, any itinerary or quotation remains a proposal, not a reservation.

11. Cancellation

Cancellation and refund conditions applicable to a confirmed booking will be provided in the applicable quotation, booking confirmation or travel agreement.

12. Changes to a Booking

You may ask us to change a confirmed booking at any time before or during your trip. We'll always try to accommodate reasonable requests, but changes may be affected by availability, price, and the itinerary, accommodation, transport or activities already arranged — not every requested change can be guaranteed.

Any change fees or additional costs will depend on the specific change, the suppliers involved, and the terms of your confirmed booking.

13. Itinerary Changes by Us

Occasionally we may need to adjust a confirmed itinerary for reasons outside our control — including weather, road closures, safety concerns, attraction closures, supplier changes, government restrictions, or other unforeseen operational circumstances.

Where this happens, we'll make reasonable efforts to let you know and to offer a suitable alternative appropriate to your booking. We won't make material changes to a confirmed itinerary without good operational reason.

14. Accommodation

Where we arrange accommodation as part of your journey, it is subject to availability and the individual property's own terms. If a confirmed hotel becomes unavailable, we'll make reasonable efforts to offer a replacement of a comparable standard, appropriate to your booking.

We do not guarantee a specific hotel, room type or view unless expressly confirmed in your booking.

15. Transport

Where we arrange transport as part of your journey — such as private, chauffeur-driven transfers between destinations — this is subject to availability and operational conditions on the day. Where transport is not included in a particular product, this will be made clear in your quotation.

16. Activities & Experiences

Activities and experiences included in your journey can be affected by weather, safety considerations, availability and local operating conditions, and some may be delivered under a supplier's own terms. Where relevant, you may need to follow safety instructions, age requirements, health or fitness requirements, or local rules set by the activity provider or site.

17. Travel Documents

You're responsible for making sure you have the documents you need for your journey — which can include a valid passport, any required visa or electronic travel authorization, travel insurance, tickets, and any required health documentation — unless we've expressly agreed to assist with a specific document as part of your booking.

Entry and visa requirements can change. Please check current requirements with the relevant official authorities — such as Sri Lanka's official immigration resources, or your nearest Sri Lankan diplomatic mission — shortly before you travel, rather than relying solely on information found on this website.

18. Travel Insurance

We strongly recommend arranging travel insurance appropriate to your journey. Good travel insurance can offer protection in circumstances such as trip cancellation, medical emergencies, baggage issues or travel disruption — though exact coverage depends entirely on your own policy. We don't provide travel insurance ourselves and can't promise what any particular policy will cover; please check the details directly with your insurer.

19. Health & Accessibility

If you have mobility needs, dietary requirements, allergies, accessibility requirements or other considerations that may affect your trip, please let us know while we're planning your journey so we can take them into account. We'll make reasonable efforts to understand and communicate relevant requirements to the suppliers involved, where our services allow, but we can't make medical guarantees or promise that every requirement can be accommodated at every location.

20. Force Majeure

We won't be responsible for a failure or delay in providing services where this is caused by circumstances beyond our reasonable control, including natural disasters, extreme weather, epidemics or pandemics, war, terrorism, civil unrest, government action, border restrictions, strikes, transport disruption, or comparable supplier failure.

Where an event like this significantly affects your journey, we'll take reasonable steps to keep you informed and, where practical, help identify suitable alternatives. This section doesn't excuse ordinary business failures on our part. Specific consequences for changes, cancellations or refunds in a force majeure situation will follow the terms of your confirmed booking and applicable law.

21. Third-Party Suppliers

We coordinate parts of your journey through third-party suppliers — such as hotels, transport providers, guides, activity providers and restaurants. We don't directly operate these services, and each supplier may have its own terms and conditions that apply to the part of your trip they deliver.

We take reasonable care in coordinating these arrangements on your behalf, but we don't exclude responsibility for everything a third party does — our responsibility in relation to third-party suppliers is addressed, subject to applicable law, in Section 25 (Limitation of Liability).

22. Website Content

We make reasonable efforts to keep the information on our website accurate and up to date. However, travel conditions change, some information may become outdated between updates, and photographs are often illustrative of a destination or experience rather than a guarantee of exactly what you'll see on a particular day. If you notice something on our website that seems out of date, we'd welcome you letting us know.

23. Intellectual Property

The Kingsbury Tour (Pvt) Ltd name, logo, website design, and the written content, photographs, graphics and other original material on this website belong to us or our licensors, and are protected by copyright and other intellectual property laws. You may view and share our website content for personal, non-commercial purposes, but you may not reproduce, republish or commercially exploit it without our permission, except where the law expressly allows it.

Where content on our website belongs to a third party, we don't claim ownership of it.

24. External Links

Our website may link to third-party websites, including WhatsApp and other services. We don't control these external websites and aren't responsible for their content or privacy practices. 26. Limitation of Liability

To the extent permitted by applicable law, Kingsbury Tour (Pvt) Ltd will not be liable for indirect, incidental or consequential loss arising from your use of this website or our services, or from the acts, omissions or insolvency of third-party suppliers who deliver part of your journey.

Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under Sri Lankan law, including liability for death or personal injury caused by our negligence, or for fraud.

27. Indemnity

To the extent permitted by applicable law, you agree to indemnify Kingsbury Tour (Pvt) Ltd against reasonable losses, costs or claims arising from your unlawful use of this website, misuse of our services, breach of these Terms, or a third-party claim caused by your unlawful conduct.

28. Termination / Suspension

We may suspend or restrict access to our website where reasonably necessary — for example, for security reasons, suspected misuse, unlawful activity, technical maintenance, or other operational requirements.

Suspending website access is separate from, and does not by itself cancel, any confirmed travel booking you hold with us. A confirmed booking is governed by the terms applicable to that booking, not by whether you can access the website at any given time.
